Welcome to Ali & Ariel
Please note that your use of the Ali & Ariel website (the “Site”) and/or your purchase of products or services from Ali & Ariel constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. Ali & Ariel reserves the right to update or modify these Terms and Conditions at any time without prior notice to you, and we encourage you to review these Terms and Conditions whenever you use this Site or purchase products and services from Ali & Ariel.

ORDER ACCURACY
Due to our efforts to verify the correctness of each order during the check-out process, we cannot be held responsible for any misspellings, design errors, or any other errors with an order once approved by the customer.
PAYMENT
Payment is due upon placing your order. Late payment fees may apply after 60 days of receiving your invoice. For payment related questions, please email accounting@aliandariel.com or call 602-529-4844. We are open Monday - Friday, from 9am - 5pm MST (closed major holidays).
DISCOUNT CODES
Discount codes, if applicable, can only be used towards individual purchases made on aliandariel.com. Discount codes cannot be applied towards custom items, or towards group and/or bulk orders. Only one code may be used at a time at checkout.
COLOR ACCURACY & GARMENT FIT
We have made every effort to display, as accurately as possible, the colors of our products that appear on our site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate. Any questions or concerns (including garment sizing & fit) must be addressed with our team prior to placing your order.
CANCELLATION POLICY
We process orders promptly to ensure you receive your order as quickly and accurately as possible. While we can't guarantee order changes or cancellations, we will do our best to help. Email or call us within 1 hour of placing your order, during business hours. Have your order and/or invoice number ready.
REFUNDS & RETURNS
All items are custom made to order, and are FINAL SALE. Any order discrepencies must be reported to us within 7 business days of your delivery date. Review your purchase carefully before ordering. The customer is responsible for selecting the correct items upon placing their order. We do not offer returns or exchanges, but we are here to make things right if something was done in our error. Your happiness is our priority.
Damaged Items
If your shipment arrives damaged, please contact us immediately at (602)529-4844 or email splash@aliandariel.com. Alternately, please contact your Stylist if applicable (custom group orders). We are not responsible for damages caused by the customer.
Shipping Policy, Custom Group Orders
All items are shipped to the Buyer for distribution. No custom group orders are shipped to individual home addresses unless specified. Please check with your Stylist regarding the delivery date of your items. This date will be approved on behalf of the Buyer. Changes with your shipping and/or delivery date may occur due to forces beyond our control. Any changes to the delivery date, should they occur, will be communicated to the Buyer as soon as possible.
Shipping Policy, Individual Ecommerce Purchases
Items can take up to 7-10 business days to process before shipping (shipping time is additional). This is clearly labeled on each item and at checkout. Should additional processing time be necessary, this will be communicated to you (the "Buyer" and/or "Client") prior to checkout. Delivery dates cannot be guaranteed. We do not suggest ordering items needed for strict delivery dates.
Shipping Disclaimer
The Seller assumes responsibility for the Goods, and all risk of damage, loss, or delay of the Goods, until the Goods are delivered to or collected by the Buyer. Once the Goods have been delivered to or collected by the Buyer, the Buyer assumes all responsibility for and risk of damage to such Goods.
International Shipping
Ali & Ariel is not responsible for any customs and taxes applied to the Buyer's order. All fees imposed during or after shipping are the responsibility of the Buyer (tariffs, taxes, etc.). Duties and/or extra fees may apply. We are not responsible for packages held at customs. Delivery dates cannot be guaranteed.
Age Restrictions
By placing an order you verify that you and order recipients are at least 18 years of age. At the time of delivery the order recipient must sign an age verification receipt stating that they are at least 18 years of age and must present a valid drivers license, military ID, passport or State ID for identification. If age verification is required for your delivery address, you'll be asked to provide your birth date as well as the details of an accepted form of identification. You can use one of the following to verify your age: Military ID Most passports Driver's license State ID We will not accept other types of ID for age verification. If you do not have one of the accepted forms of ID, you will not be able to ship this item to your delivery address.
Force Majeure
Ali & Ariel shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that Ali & Ariel will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The Client acknowledges and agrees that Ali & Ariel cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
Ownership
By providing an image or design (the “Content”) to Ali & Ariel you guarantee that you are the legal owner of the copyright or trademark of all aspects of that Content, or have been awarded full and unrestricted rights from the copyright or trademark owner to upload and utilize the Content for the purposes of purchasing products or services from Ali & Ariel or any other distribution channels including, but not limited to the Ali & Ariel’s website and social media accounts, selected third-party websites (e.g., Facebook, Twitter, Instagram, Snapchat). Images that are considered to infringe the copyright or trademarks of other individuals, organizations or companies will be not be accepted for use by Ali & Ariel.
Third Party Rights
By providing Content to Ali & Ariel you guarantee that such use of the Content by Ali & Ariel does not violate the rights of any other party, does not result in a breach of contract between you and another party and that you accept responsibility for any royalties or fees due to any other party from the use of the Content.
License to Ali & Ariel
By providing Content to Ali & Ariel, you grant Ali & Ariel, without any compensation of any kind to you or others, an non-exclusive right and license to use, copy, distribute, display, publish, perform, sell, sublicense, modify, edit, adapt, translate, transmit, create derivative works from, and otherwise exploit all Content in any form, medium or technology now existing or that may exist in the future that Ali & Ariel elects, whether now or in the future. Without limiting the foregoing, you agree that, without further approval from you, we may exercise the rights you grant us herein for any and all purposes we deem appropriate, including, without limitation, for the promotion, marketing, and publicizing of our services and products. We may, for example, use and publish the Content on our website, social media accounts, or third-party websites, in our print, broadcast and digital advertisements, in our marketing materials, and in connection with our promotional events. The right and license you grant us is perpetual, irrevocable, royalty-free, unrestricted, worldwide, and transferable without your further consent. You understand and agree that we have the option, but not the obligation, to use the Content you submit to us.
Indemnification
You agree to indemnify and hold Ali & Ariel and its subsidiaries, affiliates, officers, employees and representatives (collectively “Indemnified Parties”) free from any claim, demand, lawsuit, or request for payment in whatever form that is made by any third party against an Indemnified Party due to or arising out of the Content, including but not limited to any alleged or actual violation of any other party’s rights caused by Ali & Ariel’s use of the Content as described herein.
Non-Waiver
The approval and use by Ali & Ariel of the Content in no way alters or diminishes your responsibilities and guarantees under these terms and conditions. Ali & Ariel’s acceptance of the Content shall not be considered a waiver of any of Ali & Ariel’s rights under these terms and conditions or applicable law. Ali & Ariel expressly reserves all rights and protections under these terms and conditions and applicable laws. Ali & Ariel’s rights in these terms and conditions shall be in addition to all rights and remedies available under applicable laws.
Governing Law/Choice of Venue
The internal laws of the State of Arizona shall govern the performance of these terms and conditions, without regard to such state’s conflicts of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Maricopa County, Arizona for all disputes arising out of, or relating to, the terms and conditions and any products or services provided by Ali & Ariel.
Mobile Terms of Service

The Ali & Ariel mobile message service (the "Service") is operated by Ali & Ariel (“Ali & Ariel”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Ali & Ariel’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Ali & Ariel through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Ali & Ariel. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18559128889 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Ali & Ariel mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
